This website, teenoir.store (the "Site"), is operated by Tee Noir ("Tee Noir", "we", "us", "our"), based in Pretoria, Gauteng, South Africa.

By accessing or using the Site, or placing an order, you agree to these Terms of Service ("Terms"). If you do not agree, please do not use the Site.

2. Eligibility

You must be 18 or older, or using the Site with the consent and supervision of a parent or legal guardian, and you must be legally capable of entering into a binding contract.

3. Your account

If you create an account, you are responsible for keeping your login details confidential and for all activity under your account. Tell us immediately if you believe your account has been used without your permission.

We may suspend or close an account where we reasonably believe it has been used fraudulently or in breach of these Terms.

4. Products and descriptions

We describe our garments as accurately as we can, including fabric, construction and measurements.

Please note:

Colour may appear differently on your screen depending on your device and display settings.
Measurements are taken flat and stated with a tolerance. They are a guide, not a guarantee of fit.
Garments are produced in limited quantities and may sell out or be discontinued without notice.

5. Prices and currency

All prices are shown in South African Rand (ZAR) and include VAT where applicable. Shipping is charged separately at checkout.

We may change prices at any time, but a change will not affect an order we have already accepted.

6. Orders

Placing an order is an offer to buy, not a completed sale. A contract of sale comes into existence only when we dispatchyour order and send you a shipping confirmation.

We may decline or cancel an order, in whole or in part, where:

the item is out of stock;
there is an error in the price or description;
we are unable to authorise your payment; or
we reasonably suspect fraud or a breach of these Terms.

If we cancel an order you have already paid for, we will refund you in full.

7. Errors

Despite our best efforts, the Site may occasionally contain errors in pricing, description or availability. We reserve the right to correct any error and to cancel an affected order, even after it has been submitted, and to refund you in full. This does not affect orders already dispatched.

8. Payment

Payment is processed through our payment providers. We do not store your full card details. You warrant that you are authorised to use the payment method you provide.

9. Shipping

We currently ship within South Africa only, at a flat rate of R150 nationwide, via The Courier Guy. Dispatch and delivery timeframes, tracking and lost or damaged parcels are dealt with in our Shipping Policy, which forms part of these Terms.

Risk in the goods passes to you on delivery.

10. Returns and refunds

You have 7 days from delivery to request a return. Items must be unworn, undamaged and in original condition with tags attached, and are inspected on arrival before a refund is approved. The full terms are in our Refund and Returns Policy, which forms part of these Terms.

11. Your rights under South African law

Nothing in these Terms limits or excludes any right you have under the Consumer Protection Act 68 of 2008 ("CPA")or the Electronic Communications and Transactions Act 25 of 2002 ("ECTA").

This includes, where those Acts apply to you:

your right under ECTA to cancel certain online purchases within 7 days of receipt, without reason or penalty, bearing only the direct cost of returning the goods; and
your right under the CPA to return goods that are defective, unsafe or not as described within 6 months of delivery, for a repair, replacement or refund.

12. Intellectual property

The Site and everything on it — including the Tee Noir name, the interlocking TN monogram, garment names, photography, film, text, layout and design — is owned by or licensed to Tee Noir and is protected by intellectual property law.

You may view and share content for personal, non-commercial purposes. You may not copy, reproduce, resell, or use our brand, imagery or designs commercially without our written permission.

13. Acceptable use

You agree not to use the Site to:

break any law or infringe anyone's rights;
submit false, misleading or fraudulent information;
introduce malware or attempt to gain unauthorised access to the Site or its systems;
scrape, harvest or copy content in bulk; or
interfere with the Site's operation or security.

14. Third-party links and services

The Site may link to, or rely on, third-party services — including payment processors, couriers and social platforms. We are not responsible for the content, policies or practices of those third parties.

15. Liability

To the fullest extent permitted by law, and subject always to clause 11:

the Site and its content are provided "as is", and we do not warrant that it will be uninterrupted or error-free;
we are not liable for indirect, incidental or consequential loss, including loss of profit or opportunity; and
our total liability arising from any order is limited to the amount you paid for that order.

Nothing in these Terms excludes liability for gross negligence, fraud, death or personal injury, or any liability that cannot lawfully be excluded.

16. Indemnity

You agree to indemnify Tee Noir against any claim, loss or cost arising from your breach of these Terms or your misuse of the Site.

17. Privacy

We process personal information in accordance with our Privacy Policy and the Protection of Personal Information Act 4 of 2013 (POPIA).

18. Changes to these Terms

We may update these Terms from time to time. The version published on the Site at the moment you place an order is the version that applies to that order.
